Terms and Conditions

These terms and conditions (hereinafter the “terms”) govern the rights and obligations between the operator and the user when using the FotoLift service available on the fotolift.cz domains.

1. Operator

The operator of the FotoLift service is Qeron s.r.o., with its registered office at Kaprova 42/14, 110 00 Praha 1, Company ID (IČ): 23674822, VAT ID (DIČ): CZ23674822, contact e-mail: ahoj@fotolift.cz (hereinafter the “operator”).

2. The service

FotoLift is an online tool for the automatic editing of property photos. The user uploads photos and selects the type of edit - enhancement (correction of light, color, perspective and output cleanliness), virtual home staging (stylized furnishing of the space), a visualization following the user’s own brief, defurnishing (removal of the furniture) or an isometric view (a spatial view from above). The edited photos can further be turned into a video with optional music, logo and narrated commentary. We make the edited photos and videos available for download.

Enhancement does not change the actual condition or layout of the property. Home staging, visualization, defurnishing, the isometric view and video are stylized visualizations created by artificial intelligence; a visible “Visualization” label can be enabled on the output. The user is obliged to present these outputs as a visualization, not as the actual condition of the property.

Labelling of AI-generated content. Under Regulation (EU) 2024/1689 (the AI Act), a deployer who publishes content generated or manipulated by artificial intelligence that appears authentic must disclose that fact. This obligation applies from 2 August 2026 and in the case of FotoLift it falls on the user as the party publishing the outputs in listings and on social networks. As the provider, FotoLift supplies the tools for it - an optional visible label on the output and recommended wording for the listing - and marks the outputs with machine-readable provenance data. The user is responsible for meeting their disclosure obligation for the particular listing.

3. User account

Access is via e-mail sign-in (a one-time link sent to your e-mail) or a Google account. The user is responsible for the accuracy of the data provided, for securing access to their e-mail, and for all activity on their account.

4. Conclusion of the contract

The contract is formed by creating an account and subsequently ordering credits or a subscription. New accounts receive 3 photos free to try out. A paid order is completed once payment is made via the Stripe payment gateway.

5. Credits, subscription and prices

  • 1 credit = 1 edited photo. The first correction of each photo is free.
  • Video is charged according to its length and resolution; music, logo and narrated commentary are separately charged add-ons. The app shows the exact number of credits before you start and deducts them only afterwards.
  • New accounts have 3 photos free with no payment card required.
  • The subscription (plan) provides a monthly number of edits (credits). Unused monthly credits do not carry over to the next period. The subscription renews automatically for another period until the user cancels it.
  • Purchased credits (pay-as-you-go) are valid for 12 months and remain available to the user across subsequent periods. With an active plan, top-ups are charged at the discounted price per credit of that plan.
  • Prices are stated including VAT (21 %). Card payments are processed by the Stripe payment gateway; the tax document is issued by the operator.
  • The subscription can be cancelled at any time; the cancellation takes effect at the end of the period already paid for. No payment is refunded for the current paid period.

6. Payment terms

Card payments are made online via the Stripe payment gateway (operated by Stripe Payments Europe, Ltd.). The payment card details are entered by the user directly in Stripe’s secure environment; FotoLift has no access to them and does not store them. After payment we issue a tax document to your e-mail; billing details are optional - without them the document is issued to the user’s e-mail. Credits are added once the payment is confirmed.

7. Delivery and use of the service

The service is provided digitally and begins immediately - editing of a photo starts once it is submitted and the credit is deducted. Processing usually takes a few minutes; once finished, an e-mail with a download link is sent.

8. Withdrawal from the contract (consumer)

A consumer has the right to withdraw from a contract concluded remotely within 14 days. However, for digital content and services provided immediately, this right lapses: by submitting an edit (using up a credit), the consumer expressly requests that performance begin before the withdrawal period expires and acknowledges that they thereby lose the right of withdrawal with respect to the credits already used.

Unused credits can be returned within 14 days of purchase - write to ahoj@fotolift.cz and we will refund the proportionate amount for the unused credits. The right of withdrawal belongs only to consumers; it does not apply to businesses (purchases under a Company ID).

9. Rights arising from defective performance (complaints)

If the output does not match your request, you can use the free first correction for each photo directly in the app. A complaint can also be filed by e-mail at ahoj@fotolift.cz; we will handle it without undue delay, no later than within 30 days.

10. Content, rights and liability

The user declares that they have the right to process and edit the uploaded photos. The user grants the operator a license to process them solely for the purpose of providing the service. Rights to the edited outputs belong to the user.

The output is created by automatic editing and its specific appearance may vary; quality also depends on the quality of the input photo. The operator is not liable for the way in which the user uses the edited photos, nor for the compliance of such use with the rules of listing portals or with legal regulations.

11. Data retention and deletion

We delete both uploaded and edited photos 14 days after the last edit (each further edit of the same photo restarts the period) and generated videos after 7 days. A job left with no live photo or video is deleted 14 days after it was created. 48 hours in advance we send a notice with a download link. The service is not permanent storage - save your downloaded files in time.

12. Personal data protection

The processing of personal data is governed by the privacy policy (GDPR), available at fotolift.cz/gdpr.

13. Out-of-court dispute resolution

The authority competent for the out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI), with its registered office at Štěpánská 796/44, 110 00 Praha 1, web: www.coi.cz.

14. Changes to the terms and effectiveness

The operator may amend these terms; it will notify users of material changes by e-mail or in the app. Matters not governed by these terms are governed by the laws of the Czech Republic. These terms are effective from 1. 7. 2026.
